The Florida Real Estate Appraisal Board (FREAB) is headquartered in Orlando and consists of nine members. The FREAB administers and enforces the real estate appraiser license law, Chapter 475, Part II, Florida Statutes. The Board is also empowered to pass rules that enable it to implement its statutorily authorized duties and responsibilities. These rules are contained in Chapter 61J1, Florida Administrative Code. The Statutes and Rules, along with Chapters 455, 215, 120, and 20, Florida Statutes, as well as the Uniform Standards of Professional Appraisal Practice (USPAP) are available under “Statutes and Rules”.
The Department of Business and Professional Regulation supports the Governor in meeting his obligation to appoint qualified, representative and appropriate people to the important leadership roles within the department’s Professional Boards, Council and Commissions. Members are appointed by the Governor, subject to confirmation by the Senate. The Division of Real Estate is responsible for the examination, licensing, and regulation of real estate and real estate property appraisal professionals and corporations, real estate schools, and real estate and appraiser instructors, and Appraisal Management Companies. The division provides administrative support to the Florida Real Estate Appraisal Board. The members of the Florida Real Estate Appraisal Board work with the department in meeting its mission to, “License Efficiently. Regulate Fairly.” There are approximately 9,000 real estate appraisal licensees which include registered trainee appraisers, certified residential appraisers, certified general appraisers, real estate appraiser instructors, and Appraisal Management Companies. These licensees are regulated by the provisions of Chapter 475, Part II, Florida Statutes, and Chapter 61J1, Florida Administrative Code.
The Florida Real Estate Appraisal Board consists of nine members of which four must have been engaged in the general practice of appraising real property in this state for at least 5 years immediately preceding appointment. In appointing real estate appraisers to the board, while not excluding other appraisers, the Governor shall give preference to real estate appraisers who are not primarily engaged in real estate brokerage or mortgage lending activities. One member of the board must represent organizations that use appraisals for the purpose of eminent domain proceedings, financial transactions, or mortgage insurance. Two members of the board shall be representatives of the general public and shall not be connected in any way with the practice of real estate appraisal, and two members of the board must represent the appraisal management industry. The appraiser members shall be as representative of the entire industry as possible, and membership in a nationally recognized or state-recognized appraisal organization shall not be a prerequisite to membership on the board. To the extent possible, no more than two members of the board shall be primarily affiliated with any one particular national or state appraisal association. Two of the members must be licensed or certified residential real estate appraisers and two of the members must be certified general real estate appraisers at the time of their appointment. Members of the Florida Real Estate Appraisal Board are appointed for 4-year terms; however, a term of less than 4-years may be utilized to ensure that no more than two members’ terms expire during the same calendar year. A vacancy on the Florida Real Estate Appraisal Board shall be filled for the unexpired portion of the term of a previous member in the same manner as the original appointment and no member may serve for more than the remaining portion of a previous member’s unexpired term, plus two consecutive 4-year terms of the member’s own appointment.
The Florida Real Estate Appraisal Board meets every other month for a one day period and, unless otherwise noted, the meetings are held in Orlando. Prior to board meetings members of the Florida Real Estate Appraisal Board are expected to spend time in pre-meeting preparation. This preparation time includes reviewing agenda items, reading investigative reports and disciplinary information, reviewing applications and reading Florida Statutes or Florida Administrative Code. The average time for pre-meeting preparation ranges from ten to fifteen hours. Additionally, each member of the board is expected to serve on a probable cause panel approximately once each quarter. The probable cause panel meets once a month for approximately four hours. The member on this panel will have additional pre-meeting preparation averaging approximately ten hours. This preparation will consist of reviewing investigative reports and making a determination of the finding of probable cause to move forward with prosecution. Each member of the board receives a per diem and mileage as outlined in Section 112.061, Florida Statutes. Florida Real Estate Appraisal Board (FREAB)
Description: The Florida Real Estate Appraisal Board (FREAB) is headquartered in Orlando and consists of nine members. The Board administers and enforces real estate appraiser license law. The Board has power to regulate the issuance of licenses, certifications, registrations, and permits; to discipline appraisers; to establish qualifications for licenses, certifications, registrations, and permits; to regulate approved courses; to establish standards for real estate appraisals; and to establish standards for and regulate supervisory appraisers. These rules are contained in Chapter 61J1, Florida Administrative Code. FREAB is governed by Chapters 455, 475, 215, 120, and 20, Florida Statutes, as well as the Uniform Standards of Professional Appraisal Practice (USPAP).
