Child Labor Waiver Information

Mission Statement In conjunction with the Department’s mission to “license efficiently and regulate fairly”, the mission of the Child Labor Program is to provide a program of education, enforcement, and administrative initiatives designed to achieve full compliance in the enforcement of Child Labor laws and ensure the health, education and welfare of Florida’s working minors.
Vision Ensure the health, education and welfare of Florida’s working minors is observed in the workplace.
HB49- Employment
On March 22, 2024, Governor Ron DeSantis signed HB 49, passed by the 2024 Florida Legislature, to allow additional hours of employment for minors. HB 49 removes certain hourly restrictions for minors 16 and 17 years of age to work and provides a new exemption for those minors who are enrolled in an approved virtual instruction program. HB 917 — Career and Technical Education
On April 26, 2024, Governor Ron DeSantis signed HB 917, passed by the 2024 Florida Legislature. The bill authorizes minors aged 16 or 17 to perform limited residential construction work if the minor meets certain certification and supervision requirements. The new law will allow minors 16 and 17 years of age to work in residential construction if the minor:
- Has earned his or her Occupational Safety and Health Administration (OSHA) 10 certification.
- Is under the direct supervision of a person 21 years of age or older with at least two years of related experience and his or her OSHA 10 certification.
- Is not working on any scaffolding, roof, superstructure, or ladder above six feet.
- The work being performed by the minor 16 or 17 years of age is not in violation of the federal Fair Labor Standards Act of 1938, any Occupational Safety and Health Administration rule, or federal law related to minors in the workplace.
