The Florida Department of Business and Professional Regulation (DBPR), Division of Condominiums, Timeshares, and Mobile Homes (CTMH), offers two options to condominium associations regarding meetings and elections:

  • Option 1: Election Monitor
  • Option 2: Division Attendance at Meetings

These options are available only to condominium associations. They are not available for cooperatives, homeowner associations, or mobile home communities.

Option 1: Election Monitor Program

  • Initiated by a formal petition process of the voting members of the association.
  • A Division election monitor will conduct the election.
  • The cost is billed to the association.

Option 2: Division Attendance at Meetings

A condominium association may request that Division staff attend a condominium association meeting that is open to all members of the association.

Key points:

  • The Division’s role is observational only.
  • Division staff will not intervene in any situation during the meeting.
  • Division staff will not answer questions during the meeting.
  • There is no cost to the association for Division attendance at meetings.

General questions may be asked of Division staff after the meeting has ended.

If the Division observes any potential violations of Chapter 718, Florida Statutes, a case may be opened to address the issue.

How to Request Division Attendance

To request Division staff to attend a condominium association meeting:

  • The meeting must be open to all members of the association.
  • The request form must be submitted at least two (2) business days in advance of the meeting date.

Important: As part of this request form, include notice of the meeting, rules for the meeting, and an agenda of items the board will discuss or act upon at this specific meeting.
