Standards and Registration

Chapter 719, Florida Statutes, requires a developer of a residential cooperative to file with the Division one copy of each document required by Sections 719.503 and 719.504, Florida Statutes.  The filing shall occur at the time the cooperative is created, or prior to any offering of a cooperative unit to the public, whichever occurs first.  See Sections 719.503 & 719.504, Florida Statutes, along with Chapter 61B-79, Florida Administrative Code for more information.  Filings are submitted to the Division of Florida Condominiums, Timeshares and Mobile Homes, Bureau of Standards and Registration.

Chapter 721, Florida Statute applies to all timeshare plans consisting of more than seven timeshare periods over a period of at least 3 years in which the accommodations and facilities, if any, are located within, or offered for sale within, the State of Florida.  Single site plans are regulated under Part I, Vacation and Timeshare Plans.  Multisite plans are regulated under Part II, Vacation Clubs.  If a developer wishes to register a timeshare plan for sale, certain filing fees, forms and documents as prescribed in the statutes and rules must be filed with the Division’s Bureau of Standards and Registration for review and approval.  See Sections 721.01-721.32 & 721.50-721.58, Florida Statutes along with Chapter Chapters 61B-37 through 41, Florida Administrative Code for more information.  Filings are submitted to the Division of Florida Condominiums, Timeshares and Mobile Homes, Bureau of Standards and Registration.

Chapter 723, Florida Statutes, requires a park owner with a park containing 26 lots or more to file a prospectus with the Division.  Prior to entering into an enforceable rental agreement for a mobile home lot, the park owner shall deliver to the homeowner a prospectus approved by the Division.  With a Mobile Home Park Application package, there are filing forms and documents that are necessary to process an Initial Application; they are inclusive of but not limited to: the Prospectus, Park Owner Prospectus Filing Statement, Mobile Home Park Advertising Filing Form, Mobile Home Park Rental Agreement and Articles of Incorporation.   See Sections 723.011 & 723.012, 723.016, 723.031, 723.035, 723.037, 723.077, 723.078 Florida Statutes, along with Chapter 61B-30 & Chapter 61B-31, Florida Administrative Code for more information.  Filings are submitted to the Division of Florida Condominiums, Timeshares and Mobile Homes, Bureau of Standards and Registration.

Effective July 1, 2020, section 723.061(1)(d)2., requires that within 20 days after giving an eviction notice to a mobile homeowner, due to a change in use of the park, the park owner must provide a copy of the notice to the Division of Condominiums, Timeshares and Mobile Homes.  Click here to upload the Eviction Notices.
